DRIVER-ASSISTED CAR RENTAL AND SERVICE AGREEMENT

Parties 

The parties to this “Agreement” are Kuzey Güney VIP Transfer, with its registered address at Ercan Airport, Nicosia, Turkish Republic of Northern Cyprus (hereinafter referred to as Kuzey Güney VIP Transfer or simply “Company”), and the person who purchases the service by providing the necessary information on the online platform kuzeyguneyviptransfer.com.tr (hereinafter referred to as “Buyer”).

Kuzey Güney VIP Transfer and the Buyer shall be individually referred to as the “Party” and collectively as the “Parties.”

Subject and Service Information

Kuzey Güney VIP Transfer agrees to provide the service specified in this Agreement (“Driver-Assisted Car Rental Service”) to the Buyer under the terms of this Agreement, and the Buyer agrees to purchase the service for the specified fee and pay the fee to Kuzey Güney VIP Transfer. The Parties have mutually agreed to the following terms and conditions based on the mutual declarations and commitments provided in this Agreement:

The Driver-Assisted Car Rental Service refers to the rental of vehicles, with a driver, from kuzeyguneyviptransfer.com.tr, which provides detailed information and photos about the vehicles. The service involves transporting the Buyer from one address (point) within the Republic of Turkey (as indicated by the Buyer) to another address (point) (hereinafter referred to as “Transfer”).

Service Fee and Payment

The service fee varies depending on the service type provided on the online platform kuzeyguneyviptransfer.com.tr. The service fee is based on the vehicle selection provided on the platform, and the price does not change regardless of whether the car carries fewer passengers than its maximum capacity. For example, in a vehicle with a maximum capacity of 6 passengers, if the Buyer purchases the service for 1 passenger or up to 6 passengers, the same fee applies.

Information regarding the reservation and selected service type will be sent to the Buyer via SMS to the phone number and/or via email to the email address provided by the Buyer. Kuzey Güney VIP Transfer is not responsible for any issues arising from incorrect or non-functional contact details provided by the Buyer.

Rights and Obligations of the Parties

The Buyer agrees and undertakes that all the information provided to Kuzey Güney VIP Transfer, including identification, contact, and address details, is accurate. The Parties agree that Kuzey Güney VIP Transfer shall not be held liable for any failure to fulfill obligations arising from the Agreement due to incorrect information provided by the Buyer, and the Buyer shall be liable for indemnifying any direct and indirect damages incurred by Kuzey Güney VIP Transfer due to the incorrect information.

Necessary security measures have been taken by Kuzey Güney VIP Transfer for the protection of the information and transactions entered by the Buyer on the platform kuzeyguneyviptransfer.com.tr within the technical capabilities available. However, since the information is entered from the Buyer’s device, the Buyer is responsible for protecting it, ensuring it cannot be accessed by unauthorized individuals, and taking necessary precautions, including protection against viruses and harmful applications.

Payment Methods: Payment can be made by cash, wire transfer/EFT, or credit card. If the Buyer fails to pay the full service fee to Kuzey Güney VIP Transfer, the Company has the right to unilaterally terminate the Agreement and refuse to provide the service.

If the Buyer makes payment via credit card, and the card-issuing bank applies additional charges, Kuzey Güney VIP Transfer will not be held responsible for these charges. The Buyer should contact their bank for further inquiries.

If the Buyer prefers to pay via wire transfer/EFT, the Buyer is responsible for any transaction fees or service charges imposed by the bank. Kuzey Güney VIP Transfer is not responsible for deducting any such fees from the service fee.

The Buyer is required to provide details of the type of vehicle, the number of people traveling, and the weight and size of luggage when requesting the service. The Buyer may not request transportation of more passengers or luggage than the vehicle’s capacity. If the capacity of the vehicle is exceeded, Kuzey Güney VIP Transfer is not obligated to accept the additional passengers or luggage, and the Buyer will not be entitled to cancel the agreement. The Buyer remains obligated to pay the full service fee.

Once the Buyer has provided the details of the transfer vehicle and the luggage information, these details cannot be changed unless Kuzey Güney VIP Transfer accepts the request. If the Buyer’s change request is not accepted, the Buyer will not be entitled to cancel the agreement and must pay the full service fee. If the service fee has already been paid, no refund will be issued.

If the Buyer requests a wheelchair for a disabled person traveling, this must be communicated at least 4 (four) hours before the reservation. If any passengers are sick, the Buyer must provide documentation stating that the passenger has no contagious diseases and that there are no restrictions regarding their travel. Kuzey Güney VIP Transfer is not responsible for any damages arising from the Buyer’s failure to meet these obligations.

The Buyer and all passengers must comply with the laws of the Republic of Turkey. Passengers must wear seat belts, and the consumption of alcohol is prohibited in the vehicle. It is also prohibited to carry illegal substances or items, including drugs, in the vehicle or luggage. If Kuzey Güney VIP Transfer detects such prohibited items, it has the right to refuse the service and report the matter to the authorities. In such a case, Kuzey Güney VIP Transfer is entitled to retain the full service fee. The Buyer will be responsible for any damages caused to Kuzey Güney VIP Transfer and/or other passengers.

To receive the service, the Buyer must make the reservation at least 2 hours before the transfer time. For national holidays in Turkey, such as Ramadan Feast, Sacrifice Feast, October 29 Republic Day, and other public holidays, the Buyer must make the reservation at least 24 hours before the transfer time due to high demand and holiday-related reasons.

If the Buyer wishes to exercise the right of withdrawal, they must notify Kuzey Güney VIP Transfer in writing or by email to info@kuzeyguneyviptransfer.com, via SMS, or via WhatsApp to +90 548 861 66 at least 1 hour before the transfer time. The Parties agree that if the right of withdrawal is not exercised according to the procedure, Kuzey Güney VIP Transfer reserves all its rights. If the Buyer exercises the right of withdrawal within the specified time and in the correct manner, and if the service fee has already been paid to Kuzey Güney VIP Transfer, the Company will refund the service fee. The details of the refund process are specified in sections 5 and the following sections of this Agreement. If the Buyer cancels outside the specified time, no refund will be made.

The Buyer cannot later request changes to the transfer route after the Agreement has been concluded. The Buyer cannot request additional stops or changes in the transfer addresses. However, Kuzey Güney VIP Transfer reserves the right to charge additional fees for such requests.

Kuzey Güney VIP Transfer is responsible for ensuring that the Buyer receives a safe service and complying with the relevant regulations. The Company is also responsible for obtaining personal accident and seat insurance for the vehicles used for the services covered by this Agreement, conducting periodic maintenance, and ensuring that first aid kits are available in the vehicles.

Personal Data Processing: The personal data provided by the Buyer will be processed in accordance with the provisions of the Law No. 6698 on the Protection of Personal Data, in cases where explicit consent is required, with the Buyer’s consent, in the event of legal obligations, and/or when necessary for the performance of the service, and in the cases foreseen by the mentioned Law without the consent of the Buyer. The Buyer and the individuals who made the reservation on behalf of the Buyer are required to present identification documents upon request by Kuzey Güney VIP Transfer Transfer, to demonstrate that they have received the service covered by this agreement. In case the Buyer fails to fulfill this obligation, the service will not be provided, and Kuzey Güney VIP Transfer Transfer is entitled to the full service fee. The parties acknowledge and declare that in such a case, the full service fee will be paid to Kuzey Güney VIP Transfer Transfer.

Lost or Damaged Personal Items: In cases where the Buyer’s personal belongings are left behind, forgotten, or damaged in the vehicle, the parties acknowledge and declare that Kuzey Güney VIP Transfer Transfer has no liability. However, if Kuzey Güney VIP Transfer Transfer notices that an item has been left behind in the vehicle, they will inform the Buyer. The Buyer is responsible for collecting their belongings by cargo at their own expense within 7 business days or by coming to the address provided by Kuzey Güney VIP Transfer Transfer within 7 business days. After this period, Kuzey Güney VIP Transfer Transfer will no longer be obligated to store the items.

Pets: The Buyer or the individuals making the reservation on their behalf can request to transport “pets” under the condition that the pets are in a cage and accompany them. However, this request must be communicated to Kuzey Güney VIP Transfer Transfer at the time of reservation. The Buyer acknowledges and declares that the pets comply with all health-related regulations in the applicable law. Pets such as birds, cats, and dogs can be transported, but prohibited animals under the law cannot be carried. The cage size can be a maximum of 234055 cm.

Delays: If the Buyer or passengers fail to be ready at the specified time or are late, Kuzey Güney VIP Transfer Transfer will attempt to contact the Buyer via the provided phone number. If the Buyer cannot be reached, Kuzey Güney VIP Transfer Transfer will wait up to 15 minutes. If the Buyer provides a delay notification, Kuzey Güney VIP Transfer Transfer will wait for up to 20 minutes. In these cases, Kuzey Güney VIP Transfer Transfer will be entitled to the full service fee, and no further obligations will arise from the delay.

Force Majeure: In cases of traffic accidents, road closures by official authorities, floods, natural disasters, or other force majeure events, Kuzey Güney VIP Transfer Transfer will not be held responsible if it cannot provide the service. However, if Kuzey Güney VIP Transfer Transfer is unable to provide the service at the promised time for legitimate reasons, Kuzey Güney VIP Transfer Transfer will contact the Buyer and inform them. In such cases, Kuzey Güney VIP Transfer Transfer will compensate the Buyer for the material damage, up to a maximum of 400 TRY, provided that the damage is documented. If Kuzey Güney VIP Transfer Transfer is delayed beyond the 20-minute waiting period, no payment will be required from the Buyer, and an alternative service will be offered. The Buyer is not obligated to accept the alternative service. In this case, Kuzey Güney VIP Transfer Transfer will compensate the Buyer’s material damage up to 400 TRY, provided the damage is documented. This compensation is limited to the transfer service and does not cover other damages (e.g., missed flight tickets).

Driver’s Responsibility: The driver’s only responsibility during the “Chauffeured Car Rental Service” is to drive the vehicle to the required destination in accordance with the law. The driver is not obligated to assist with baggage handling, pet transport, or accompany the passenger to the door at the destination, among other things.

Liability for Accidents and Damage: Both parties acknowledge and declare that Kuzey Güney VIP Transfer Transfer has no liability in case of an accident or other incidents causing damage to the Buyer, passengers, or their belongings during the transfer. In such situations, the Buyer agrees to waive any claims against Kuzey Güney VIP Transfer Transfer under the provisions of the Turkish Civil Code.

Cancellation and Refund Policy:

5.1. Both parties agree that the Buyer will not be able to cancel the contract and Kuzey Güney VIP Transfer Transfer will not be obliged to refund the service fee if the period specified in this agreement has passed.

5.2. If the Buyer wishes to make any changes to the reservation, they must notify Kuzey Güney VIP Transfer Transfer at least 1 hour before the transfer time. Kuzey Güney VIP Transfer Transfer has the right to refuse to accept the change request.

5.3. If Kuzey Güney VIP Transfer Transfer needs to cancel or modify the reservation or transfer due to force majeure situations, such as vehicle issues, weather, traffic accidents, or road closures, Kuzey Güney VIP Transfer Transfer will not be required to refund the service fee unless there is fault on their part.

5.4. The change request can be sent by the Buyer to the email address reservation@kuzeyguneyviptransfer.com, or via call center or SMS to the number +90 548 861 66 16. The Buyer should provide the reservation code, identification details, and the request.

5.5. Kuzey Güney VIP Transfer Transfer will refund the service fee via the same method used for payment (i.e., if the payment was made by credit card, the refund will be made to the same card). If the service fee was paid in installments, the refund will also be made to the same card in installments. If there are delays in processing refunds due to holidays or bank traffic, Kuzey Güney VIP Transfer Transfer will not be held liable. If any transaction fees arise during the refund process, these fees will be deducted from the service fee, and the remaining amount will be refunded. Refund processing times may vary depending on whether the payment was made through Turkish banks.

5.6. Kuzey Güney VIP Transfer Transfer has the right to withhold the service fee until the necessary approvals are received if any suspicious transactions are reported during or after the payment process.

5.7. The Buyer may not assign or transfer any rights or obligations arising from this agreement to any third party.

5.8. Turkish Law applies to this agreement. The parties agree that in case of any disputes arising from the interpretation or implementation of this agreement, the competent courts and enforcement offices of the Turkish Republic of Northern Cyprus (K.K.T.C.) will have jurisdiction.
